On the direct line of the Ministry of Defense, which was launched after the announcement of mobilization, in response to a question from Baza “what to do if a summons came, and you are not at home”, they answered that failure to appear on the agenda only provides for an administrative fine, and not criminal punishment.
“At the moment, liability for failure to appear at the military registration and enlistment office provides for 21.5 of the Code of Administrative Offenses “Failure by citizens to fulfill military registration obligations.” Punishment – a fine in the amount of 500 to 3 thousand rubles. There is no criminal punishment for failure to appear on the agenda subject to mobilization. A citizen is mobilized and receives the rights and duties of a serviceman only after arriving at the military commissariat, passing a medical examination, the decision of the mobilization commission and issuing the corresponding order of the military commissariat. If a citizen evades after that, he may be liable under the recently adopted Article 337 of the Criminal Code of the Russian Federation,” the response says.
Earlier today (September 23), the German authorities stated that the evasion of mobilization is a compelling reason for the positive consideration of the application for political asylum in Germany. The same goes for deserters.
A corresponding instruction has been given to the Federal Office for Migration and Refugees.
