In Penza, the first criminal case has been initiated for evading mobilization (Article 328 of the Criminal Code of the Russian Federation), Pavel Chikov, head of the Agora human rights organization, reports .

The case is being investigated by the Zarechensky Interdistrict Investigation Department of the ICR. The suspect is 32 years old, he refused to sign the summons to the draft board. He was detained by OMON officers, he has been in a temporary detention center for two days already, Chikov writes.

On October 5, the investigator must apply to the court for a preventive measure.

Chikov notes that, "according to the clarifications of the Supreme Court of the Russian Federation, Article 328 of the Criminal Code of the Russian Federation applies only to citizens who evade conscription for military service." The detainee's lawyer filed a motion to terminate the criminal prosecution.
