The prosecutor's office declared illegal the decision to initiate the first criminal case on evasion from appearing on the mobilization summons, said human rights activist Pavel Chikov.
“The Prosecutor's Office of the Penza Region [honored the Plenum of the Supreme Court and] recognized the decision to initiate proceedings as illegal. The suspect received the right to rehabilitation, including compensation for what was caused by the 48-hour detention,” Chikov wrote.
The Investigative Committee will appeal against the prosecutor's decision.
The case in question concerns 32-year-old Maxim Moiseev. He was detained a few days ago, accused under article 328 of the Criminal Code of the Russian Federation (“Evasion of military service”), as he refused to accept summons.
Moiseev's wife said that the summonses that they tried to hand him were drawn up with errors, so he refused to accept them. According to her, after the detention, her husband was kept in a temporary detention center for two days, and then they were released to go home on bail.
