“Kommersant”: Rostec through the court wants to return the advance for aircraft not delivered due to sanctions, but the chances of success are zero

Rostec's leasing subsidiary, Aviacapital Service, is trying to recover $200 million in advance from the European aircraft manufacturer Airbus for aircraft that were not delivered to it due to sanctions. According to Kommersant, on December 13, the lawsuit was filed with the Moscow Arbitration Court.

The lawsuit concerns 17 A350 passenger aircraft. The contract for their supply was concluded in 2015, in the future the company planned to lease the aircraft to Aeroflot. However, not a single aircraft ever reached the customer.

Lawyers interviewed by Kommersant say that the chances of returning the advance are zero. The reason is that European sanctions prohibit any financial relationship with Russian companies.

The same applies to other Russian companies that could potentially file similar claims, such as Aeroflot, which ordered 22 aircraft from Airbus, but managed to receive only seven.
