The court extended compulsory treatment in a psycho-neurological dispensary for the Yakut shaman Alexander Gabyshev. Alexey Pryanishnikov, Gabyshev’s lawyer, in a conversation with The Insider noted that the court did not explain on the basis of which it was concluded that the shaman was “publicly dangerous”, moreover, the results of the examination show that he is not dangerous either to others or to himself:
“Today there was another court session, where the issue of the advisability of extending compulsory treatment was decided. There was a re-examination by psychiatrists, and they issued a conclusion that he still had to stay in a special type hospital. At the same time, the conclusion contains an unfounded assertion that he represents a public danger. But it is not deciphered on the basis of which such conclusions are made. Moreover, the conclusion in the last conclusion suggests that he does not show auto-aggression and aggression towards others. There are no main criteria for determining public danger. Based on this, I petitioned for the appointment of a psychiatric examination. How many such applications have already been filed in the last 3.5 years. Naturally, these petitions were denied with the motivation: “There is no reason not to trust the conclusion of psychiatrists from the hospital in Ussuriysk.” It is believed that their conclusions are correct and objective.
After the May holidays, there will be a second re-examination, the documents will be sent back to the Ussuriysky District Court, and the next decision on the extension or transfer to a milder type of psychiatric hospital will be made around the end of June 2023. I hope that Alexander will leave Ussuriysk and be transferred to a general hospital or released. I would not consider the transfer to a general hospital to be such an achievement, because it will be a hospital at the place of his residence, with which everything began 3.5 years ago, when Alexander's ordeals began in these psychiatric hospitals.
The conclusions of the court regarding Alexander were repeatedly refuted by the great and eminent psychiatrists who have stood at the origins of independent psychiatry in Russia since 1992. They refuted all the arguments about public danger, and Alexander's diagnosis, and the need for hospitalization, but nevertheless, the courts in his administrative and criminal cases have always taken, in my opinion, a biased position. Never, not once has our petition been granted to send these cases or Alexander himself to the Research Institute. Serbian. We believe that any specialist in the Institute who is not involved in treatment at the moment will come to the conclusion that this person should not be kept in any psychiatric hospitals.
The case against Gabyshev was initiated in February 2021. He was accused of using violence against a representative of the authorities (Article 318 of the Criminal Code of the Russian Federation). According to investigators, the attack took place on January 28, 2021, when law enforcers came to the shaman’s house and were supposed to re-send him to the Yakut psychiatric hospital. Shortly before that, he announced that he was going to make a new trip to Moscow.
Gabyshev's first campaign from Yakutia to Moscow began in March 2019. He claimed that he planned to walk 8,000 kilometers in order to “expel Putin.” In the autumn of the same year, a criminal case was opened against him for public calls for extremist activities. In October, a psychiatric examination declared him insane.
