The Zaozersky garrison military court (Murmansk region) sentenced Anton N., deputy commander, political officer of a motorized rifle company, to two years in prison in the case of failure to comply with the order of the command. This was reported by the Telegram channel "Military Advocate", which is run by lawyer Maxim Grebenyuk.
According to the materials of the investigation, the political officer twice refused to comply with the order and. O. the commander of his unit to be sent to the combat zone in Ukraine. After that, in March 2023, he notified the commander of the battalion, which includes his company, of his refusal.
It is noted that the servicemen of the unit in which Anton N. served were subsequently sent to war, and a criminal case was initiated against him under Part 2.1 of Art. 332 of the Criminal Code of the Russian Federation.
The prosecution demanded two years and ten months of a colony-settlement for the political officer and a two-year ban on holding organizational and administrative positions. As a result, the court sentenced Anton N. to two years in a colony-settlement and a year of a ban on holding the above positions.
The State Duma adopted the current wording of Article 322 of the Criminal Code on September 20, 2022, before the start of “partial” mobilization. It provides for punishment of up to three years in prison in case of failure to comply with the "legal" order of the command.
For the first time, the initiation of a case on it became known at the end of October 2022. In February 2023, under article 322 of the Criminal Code, a case was initiated against military medic Denis Vasiliev, who refused to go to the front.
