The Gatchina Court of the Leningrad Region satisfied the claim of the mobilized Pavel Mushumansky and recognized his conscription as illegal. Lawyer Pavel Chikov wrote on his Telegram channel that the court ruled in favor of the conscript for the first time.
Prior to mobilization, Mushumansky was doing alternative civilian service instead of fixed-term military service. After the announcement of mobilization, he was called up and sent to a military unit. Mushumansky then applied to the court, which suspended the decision on mobilization until the case was considered on the merits.
On November 29, the St. Petersburg City Court rejected the appeal of 27-year-old Kirill Berezin, who, after being called up for mobilization, refused to take up arms, fled the military unit and demanded that he be transferred to alternative civilian service. Berezin, in his complaint, challenged the decision of the court of first instance, which considered it lawful that he was called up as part of the mobilization. After the court session, Berezin had a panic attack, he was taken to the hospital, after which he was taken to a military unit on Vasilyevsky Island.
